What is the time limit to file a consumer complaint?
Under the Consumer Protection Act, 2019, a complaint must be filed within 2 years from the date of cause of action (i.e., when the deficiency or defect occurred). The Forum can condone delay beyond 2 years if sufficient cause is shown. File as early as possible to avoid complications.
Do I need a lawyer to file a consumer complaint?
No. Consumer forums are designed to be accessible to consumers without legal representation. You can represent yourself (in person or through an authorized agent). However, for complex matters or large claims, having a lawyer can be beneficial. Filing is relatively simple — you submit the complaint with supporting documents and pay the filing fee.
What documents should I attach with the complaint?
Attach: (1) Purchase invoice/receipt, (2) Warranty card, (3) Email/written correspondence with the company, (4) Photos of defective goods, (5) Any repair bills, (6) Copy of any complaint made to the company's customer care, (7) Any other evidence supporting your claim. Keep originals and submit attested copies.
Can I file an online consumer complaint?
Yes. The National Consumer Disputes Redressal Commission (NCDRC) has an online filing portal at edaakhil.nic.in. Consumers can file complaints online, track status, attend hearings virtually, and upload documents. This is available for District, State and National Commissions.
What can I claim as compensation in a consumer complaint?
You can claim: (a) refund of the purchase price, (b) replacement of goods, (c) removal of defects, (d) compensation for mental agony and harassment, (e) punitive damages, (f) litigation costs. The amount should be reasonable and supported by evidence. Forum will determine the final award after hearing both parties.
