Who is responsible for setting minimum wages in India?

Under the Minimum Wages Act, 1948, both the central government (for scheduled employments under its control) and state governments (for employments under their jurisdiction) can fix and revise minimum wages. The Code on Wages, 2019 (not yet fully implemented) proposes a national floor wage below which no state can set its rates.

What is the difference between unskilled, semi-skilled and skilled workers?

Unskilled workers perform routine tasks requiring no special training (e.g., loading/unloading, sweeping). Semi-skilled workers have some training or experience (e.g., machine operators, helpers). Skilled workers have specific trade skills or expertise (e.g., carpenters, electricians, welders). Highly skilled workers are those with professional or technical qualifications.

What happens if an employer pays below minimum wage?

Paying below the notified minimum wage is a criminal offence under the Minimum Wages Act, 1948. Penalties include imprisonment up to 6 months, fine up to ₹500 per offence, or both. Workers can file a complaint with the Labour Commissioner or Minimum Wages Inspector. The employer is also liable to pay the shortfall to the worker.

Does minimum wage include allowances like HRA and DA?

Minimum wage notifications typically specify the basic wage plus variable dearness allowance (VDA). House Rent Allowance (HRA) and other allowances may or may not be included depending on the state notification. The VDA is revised twice a year (April and October) based on the Consumer Price Index.

Is there a national minimum wage in India?

Currently, India does not have a uniform national minimum wage. The central government recommends a national floor minimum wage (currently around ₹178/day for non-agricultural workers), but this is only advisory — not mandatory. States are free to set higher rates. The Code on Wages, 2019 aims to introduce a mandatory national floor wage once fully implemented.
